By accessing the Website, creating an account, or placing an order, you agree to be legally bound by these Terms. If you do not agree, you must not use the Website. These Terms constitute a legally binding agreement between you and the Company.
For the purposes of these Terms, “Products” refer to precious metals including, but not limited to, gold and silver bullion, bars, and coins. “User”, “you”, or “your” refers to any person accessing or using the Website. “Order” means a request submitted by you to purchase Products. “Business Day” refers to any day other than a Saturday, Sunday, or public holiday in Singapore.
You must be at least 18 years old and legally capable of entering into binding contracts under applicable laws. By using the Website, you represent and warrant that you meet these requirements, that all information provided is accurate and complete, and that you are not using the Website for any unlawful purpose.
To place an order, you are required to create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities conducted under your account. You agree to provide accurate and up-to-date information and to promptly update any changes.
You must notify us immediately of any unauthorized access or use of your account. We reserve the right to suspend or terminate your account at our discretion, including in cases of breach of these Terms, suspected fraud, or unlawful activity.
We make reasonable efforts to ensure that all product descriptions, images, and specifications are accurate; however, minor variations may occur. All Products are subject to availability, and we do not guarantee that items will always be in stock. We reserve the right to limit quantities or allocate Products at our discretion.
Prices for precious metals are based on live market rates and may change without notice. Prices are only locked in upon successful order placement and receipt of the required down payment within the stipulated timeframe.
In the event of a pricing error, we reserve the right to cancel or refuse any affected order. Where applicable, any payments made will be refunded.
An Order submitted by you constitutes an offer to purchase. An order is only deemed accepted upon full payment being received by the Company.
We reserve the right to reject or cancel any order at our discretion, including in cases of pricing errors, suspected fraud, regulatory concerns, or product unavailability.
Full payment must be completed within 24 hours of order placement. Accepted payment methods include PayNow and bank transfer.
If payment is not received within the specified timeframe, the order may be cancelled and any applicable price lock will be forfeited. You agree not to initiate unjustified chargebacks. We reserve the right to take appropriate action, including account suspension and legal recovery.
Due to the fluctuating nature of precious metals markets, all confirmed orders are final and binding. No cancellations, returns, or refunds will be permitted once payment has been confirmed, except at our sole discretion.
Orders may be delivered to the address specified at checkout, subject to payment of applicable delivery fees, or collected in person at our designated office strictly by prior appointment.
Delivery fees are non-refundable once paid, including in cases where you subsequently choose to switch to self-collection.
Orders will only be processed after full payment has been successfully received and confirmed. Any delivery timelines provided are estimates only and are not guaranteed. While we will make reasonable efforts to ensure timely delivery, delays may occur due to factors beyond our control.
If delivery cannot be completed due to incorrect information, absence of the recipient, or refusal to accept delivery, additional charges may apply for re-delivery or handling. We shall not be liable for any loss arising from such circumstances.
Given the high value of precious metals, we reserve the right to use secure or insured delivery services and to delay or refuse delivery where necessary for security or compliance reasons.
We are not responsible for delays caused by logistics providers, regulatory checks, customs processes (for international shipments), or events beyond our reasonable control. For international deliveries, you are responsible for any applicable duties, taxes, or import restrictions.
Any buyback transaction is subject to our prevailing buyback prices, which may differ from selling prices and are determined based on current market conditions.
All buyback requests are subject to verification of product authenticity, condition, and ownership. We reserve the right to refuse any buyback request or revise the buyback price after product verification.
Payment for buyback transactions will be made via methods determined by the Company for large transactions and may be subject to identity verification and compliance checks.
You acknowledge and agree that transactions involving precious metals carry inherent financial risks. Prices of gold and silver are highly volatile and may fluctuate significantly due to market conditions, economic factors, and global events.
By placing an order or engaging in any transaction, you confirm that you understand and accept these risks and that you are making independent decisions without reliance on any representations or advice from the Company. The Company does not provide financial, investment, or trading advice.
You further acknowledge that past performance of precious metals is not indicative of future results and that you bear full responsibility for any losses incurred.
We may require you to provide identification documents and other information to comply with applicable regulatory requirements, including anti-money laundering and counter-terrorism financing obligations.
We reserve the right to refuse or cancel any transaction and to report suspicious activities to the relevant authorities where required.
You agree not to use the Website for any unlawful purpose, including fraud or money laundering, or to interfere with the operation or security of the Website. Unauthorized access or misuse of the Website is strictly prohibited.
All content on the Website is owned by or licensed to D’Exchange Pte Ltd and is protected by applicable intellectual property laws. You may not reproduce, distribute, or use any content without prior written consent.
We may rely on third-party service providers, including market data providers, payment processors, and logistics companies. We are not responsible for any disruption, delay, or error caused by such third parties.
To the fullest extent permitted by law, the Company shall not be liable for any indirect, incidental, or consequential losses, including losses arising from market fluctuations, loss of profits, or service interruptions.
You agree to indemnify and hold harmless the Company from any claims, losses, damages, or expenses arising from your breach of these Terms, misuse of the Website, or violation of any applicable law.
We shall not be liable for any failure or delay in performance resulting from events beyond our reasonable control, including but not limited to natural disasters, war, civil unrest, system failures, or government actions.
We reserve the right to suspend or terminate your access to the Website immediately, without prior notice, for any breach of these Terms. Any obligations incurred prior to termination shall remain in effect.
These Terms shall be governed by and interpreted in accordance with the laws of Singapore. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Singapore.
